This Privacy Policy explains how Backtest Ltd. ("Backtest," "we," "us," or "our"), the operator of Backtest.ai and its related applications, software, and services (together, the "Service"), collects, uses, discloses, and safeguards your personal information. Backtest Ltd. is the organization accountable for the personal information under its control. This Policy should be read together with our Terms of Use, and terms defined there have the same meaning here. By using the Service, you agree to the practices described in this Policy.

1. Information We Collect

Information you provide to us. This includes the information you enter when you create an account (such as your name and email address) and set a password; billing details when you subscribe to a paid plan; the content of messages you send us; and information you submit through our forms, including any beta application or waitlist form. It also includes the strategies, models, code, configurations, parameters, and other content you create, upload, or store using the Service (referred to in our Terms as "Your Content").

Brokerage connection information. Where the Service supports connecting a third-party brokerage account and you choose to connect one, we collect the credentials or access tokens needed to establish and maintain that connection. We use this information only to provide the connection and related features you request, and we store sensitive credentials using the safeguards described in Section 7.

Information collected automatically. When you use the Service, we and our analytics provider automatically collect certain technical information, such as your IP address, device and browser type, pages and features viewed, actions taken, referring pages, and similar usage data. We collect this information using cookies and similar technologies, as described in Section 5.

2. How We Use Your Information

We use personal information to:

  • provide, operate, maintain, secure, and improve the Service;
  • create and manage your account and authenticate you;
  • process payments and administer subscriptions;
  • respond to your inquiries and provide support;
  • send you transactional messages about your account and the Service;
  • send you marketing or product communications where you have consented or where otherwise permitted by law, from which you can opt out at any time;
  • analyze how the Service is used so we can improve it;
  • detect, prevent, and address fraud, abuse, security issues, and technical problems; and
  • comply with our legal obligations and enforce our Terms.

Under Canadian privacy law, we rely on your consent (express or implied, depending on the context and the sensitivity of the information) as the basis for collecting, using, and disclosing personal information. Where you are located in another region, additional legal bases may apply, such as the performance of our contract with you, our legitimate interests, or compliance with a legal obligation.

3. How We Share Your Information

We do not sell your personal information.

Service providers. We share personal information with third parties that process it on our behalf, under contract, to help us operate the Service. These currently include Stripe (payment processing), PostHog (product analytics), Customer.io (email and messaging), Tally (forms), Google Workspace (email and productivity), and our hosting and infrastructure providers (including Vercel) that run our application and store our data. This list may change as the Service evolves. Payments are processed by Stripe, and we do not collect or store your full payment card details.

Your Content. We do not share Your Content with other users or make it public as part of any community or shared feature without your express opt-in.

Legal and safety. We may disclose personal information where we believe in good faith that it is necessary to comply with applicable law or legal process, to enforce our Terms, to detect or prevent fraud or security issues, or to protect the rights, property, or safety of Backtest, our users, or others.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction. We will take reasonable steps to ensure it remains subject to protections consistent with this Policy.

4. Where Your Information Is Processed

We are based in Canada, and some of our service providers are located in the United States and other countries. As a result, your personal information may be processed and stored outside your province or country of residence, including in the United States, where it may be subject to the laws of those jurisdictions and accessible to courts, law enforcement, and other authorities under those laws. We use contractual and other appropriate measures to protect personal information that is processed by our service providers.

5. Cookies and Similar Technologies

We use cookies and similar technologies to operate the Service, keep you signed in, remember your preferences, and understand how the Service is used through our analytics provider. You can control or disable cookies through your browser settings, though some features of the Service may not work properly if you do. We do not currently use cookies for third-party advertising or cross-site tracking.

6. Data Retention

We retain personal information for as long as it is needed to provide the Service and for legitimate business or legal purposes, such as meeting our record-keeping, tax, and compliance obligations and resolving disputes. Account information is generally retained while your account is active and for a reasonable period afterward. When personal information is no longer required, we delete it or anonymize it.

7. Security

We use commercially reasonable technical and organizational measures to protect personal information, including encryption of data in transit, encryption of sensitive credentials such as brokerage access tokens, and access controls that limit who can access personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for securing the devices and networks you use to access the Service.

8. Your Privacy Rights

Subject to applicable law and to certain legal and contractual limits, you may:

  • request access to the personal information we hold about you;
  • request that we correct inaccurate or incomplete personal information;
  • withdraw your consent to our collection, use, or disclosure of your personal information, understanding that this may limit or prevent our ability to provide the Service; and
  • ask questions or raise concerns about how we handle your personal information.

You can exercise these rights by contacting us at admin@backtest.ai. We may need to verify your identity before responding. If you are not satisfied with our response, you have the right to contact the Office of the Privacy Commissioner of Canada.

Marketing communications. You can opt out of marketing emails at any time using the unsubscribe link in those messages. We send marketing communications in accordance with applicable law, including Canada's Anti-Spam Legislation. Opting out of marketing does not affect transactional messages necessary to provide the Service.

Users in other regions. Depending on where you live, you may have additional rights under local privacy laws, such as the right to request deletion or a copy of your personal information, or to opt out of certain processing. We do not sell personal information or use it for cross-context behavioral advertising. To exercise any such rights, contact us at admin@backtest.ai and we will respond as required by applicable law.

9. Children

The Service is intended for users who are at least 18 years of age. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will take appropriate steps to delete it.

10. Changes to This Policy

We may update this Policy from time to time. If we make a material change, we will post the updated Policy with a new "Last updated" date and, where required by law, take additional steps to notify you. Your continued use of the Service after the update takes effect means you accept the revised Policy.
